Father Charged With Felony Injury to Child After 10-Day Old Infant Dies

The Ada County Sheriff’s office said a 10-day old infant died after being wedged between the couch and father. The father was asleep while being under the influence of alcohol. He was arrested and charged with felony injury to child.

The man is identified as Kody Durfee, a 32-year-old man and the father to the infant child from Boise, Idaho. The Ada County Office further informed that the man was on parole for drug convictions and felony DUI. As per the parole agreement, he was not allowed to drink alcohol. The accident happened on the evening of December 15. The police said he admitted to drinking alcohol at his home in Desert Avenue and Cole road area. He then falls asleep with the baby on his chest.

When the other family members came home, they found the child unresponsive. They performed CPR and called for 911. The paramedics performed CPR on the way to the hospital and were taken to the nearby hospital but were declared dead after a short while.

Immediately after the infant’s death, the investigator interviewed the accused and was sent to Ada county jail for parole violations and was also further booked for injuring a child. He is also charged for felony enhancement count of infliction for causing bodily injury.

“The crime of felony injury to child, with the great bodily injury enhancement, is punishable by up to 30 years in prison,” informed the sheriff’s office in the press release.

The accused was scheduled to appear in court on 23rd Dec in the afternoon. He will face 30 years in prison for his crimes. Previously, Durfee received an 18-year sentence in 2015 for driving under influence. This had been the second time that Durfee was charged with DUI.
