Underage DUI

Boise Underage DUI Lawyers

The repercussions of an underage DUI conviction are serious in the state of Idaho, as they are across the country. Idaho enforces stringent laws concerning those under the age of 21 who drink, and then get behind the wheel. The consequences can linger well into the future of a young person convicted of this offense.

There are more ways to fight these charges than many people realize. The underage DUI lawyers in our Boise office have a detail-oriented understanding of the relevant law, how to investigate these charges, and what it takes to defend their clients. Before rushing to plead guilty, make sure you call our office first.

Trilogy Law Group is available by phone 24/7. Just reach out at (208) 415-9943.

The Penalties for Underage DUI in Idaho

It’s important to note that the blood alcohol content (BAC) level threshold for a DUI is much lower for a minor than for someone who is over the age of 21. For an adult DUI charge, the BAC level must be at least 0.08% to be considered driving under the influence.

However, for minors, even a 0.02% BAC level while driving will be considered a DUI. The consequences of that can include:

  • Fines: For first-time offenders, fines could be as high as $1,000, plus a one-year license suspension. For a second DUI charge, fines could go to $2,000, plus license suspension for up to two years. A third DUI can include all of that and six months of jail time.
  • Confinement: Those aged 18-20 are at risk of jail time. Offenders under the age of 18 will not likely be tried as adults, but it is possible they could serve out a confinement sentence in a juvenile center.
  • Community service: An underage DUI offender might be able to perform some form of community service as an alternative to jail time.
  • IID installation: An acronym for an Ignition Interlock Device, IID is a breath analyzer that is attached to a vehicle’s ignition. It stops the car from starting if it detects alcohol in the driver’s breath. Installing this device is one of the penalties for underage DUI in Idaho.

The Social Consequences of an Underage DUI Conviction

What’s above are just the penalties imposed by the legal system. A DUI conviction can be damaging to one’s college application, particularly if that application involves scholarship funding and financial aid. The DUI conviction will come up in a background check. The same problem can hinder people when they go into the workforce, as a past DUI may deter a potential employer from hiring them.

Take Prompt Action to Protect Yourself or the Person You Love

The consequences of underage DUI convictions are far-reaching. If you or someone you love is facing these charges, the best approach is to stay calm and be proactive. That starts with a phone call to our office.

Our Boise underage DUI lawyers will thoroughly investigate your case. Did the police officer have probable cause to make the traffic stop to begin with? If not, any evidence gathered at that stop—which, in DUI cases, is often the full scope of the evidence—can be thrown out.

Is it possible the breath or blood test produced an inaccurate result? Breathalyzer instruments must be properly maintained, and blood tests face strict chain of custody requirements. Other factors, such as certain types of food, medicines, and health conditions, can also trigger so-called “false highs” on a BAC reading. If there’s a path to acquittal, we’ll work to find it.
