A man has been sentenced to 43 days in jail for causing a fatal DUI crash in Salmon that resulted in the death of his wife. He was identified as Joshua Lee Kion, 30. The accident which resulted in the indictment of Kion took place back in October last year.
According to the details made available in court documents, Kion was traveling along the U.S. Highway 93 at the time of the crash. He was driving an SUV and was accompanied by his wife, Brittany Kion. The vehicle suffered a single-vehicle crash which caused it to overturn.
By the time the first responders and paramedics reached the crash scene, Brittany Kion had succumbed to her injuries. She was pronounced dead on the scene of the accident. Deputies with the Lemhi County Sheriff’s Office also responded to the incident.
When the deputies arrived, Joshua confessed that he was intoxicated and had been driving under the influence. He had also suffered injuries in the crash, so the paramedics transported him to the Steele Memorial Hospital. A blood sample was drawn and tested for blood alcohol concentration (BAC). However, the results from the blood test were not included in the court documents.
According to the deputies, Joshua then made other statements as well confirming that he was under the influence when the fatal DUI crash in Salmon occurred. Based on the available evidence, the prosecutors had originally brought felony DUI and felony vehicular manslaughter charges against Joshua.
Earlier last month, Joshua was able to reach a plea agreement with the prosecutors. Under this agreement, both charges against him were reduced to misdemeanors and he pled guilty to both. Based on this, a court sentenced him to 43 days in jail. Once this sentence ends, Joshua will also be required to undergo four years of probation.
