Boise Woman Faces Felony DUI Charges for Fatal Crash

A Boise woman has been charged with felony DUI charges. The woman, Anna Mihelich, 53, was involved in a fatal crash that resulted in the death of a 3-year-old. Mihelich currently faces four charges of felony aggravated DUI. Boise woman faces felony DUI charges for fatal crash.

The crash took place on July 2 near the Diamond Street. Milhelich was driving an SUV at the time. She crashed into a van which was being driven by Crystal Martinez Chavez. Chavez and her three children sustained serious injuries in the crash. They were rushed to the hospital. One of Chavez’s children, a girl aged 3, succumbed to her injuries on July 8. The condition of Chavez and her other two girls is not known at this time.

After being charged with multiple counts of felony DUI, Milhelich was booked into the Ada County Jail on Oct 1. The Boise Police Department booked her into the jail. Information from the investigation completed by the police has also been forwarded to the Ada County’s Prosecutor’s Office. The prosecutor will now determine the charges that can be pursued against Milhelich.

So far, the authorities have not released the toxicology report of Milhelich. Once the report becomes public, it will be possible to see how drunk she was when she caused the accident. As per the court records, it is unclear whether or not Milhelich has hired an attorney so far. She may be able to counter the multiple felony DUI counts over different grounds. However, the fact that her DUI resulted in a crash and a fatality of a minor will inevitably result in a harsh punishment.

In addition to the criminal charges, Chavez and her family may also be able to pursue civil litigation against Milhelich. Such litigation can result in an award of compensatory damages for the immense loss of the plaintiffs.
